The Ministry of Public Security has recently issued Circular 73/2024, which comprises 5 chapters and 33 articles, governing patrol, monitoring, and handling of violations related to road traffic safety and order by the traffic police. This circular will take effect on January 1, 2025.
The circular specifies regulations on forms, content, uniforms, equipment, use of technical tools, weapons, and support tools for patrol and control. It also includes the processes for addressing violations of road traffic laws and mobilizing other forces within the People’s Police to assist traffic police when necessary.
Article 5 of the circular outlines regulations for using systems, devices, and databases to monitor road traffic safety and order.
Specifically, in addition to monitoring traffic through camera systems installed along roads and in urban areas, the traffic police will be able to access data from journey monitoring devices and driver image recording systems.
Clause 2, Article 5 states: “Monitoring will be conducted using professional technical devices, smart tools for commanding and controlling road traffic; and by accessing data from journey monitoring devices, driver image recording systems, and databases related to road traffic safety and order.”
Traffic police units are authorized to utilize professional technical equipment (including devices for inspecting the weight of motor vehicles), smart tools for traffic command and control, and data from journey monitoring devices, driver image recording systems, and traffic safety databases. These tools will help detect and address violations of road traffic laws and other legal infringements.
The data collected from these tools must comply with legal provisions regarding administrative violations, as well as Decree 135/2021, which governs the standards and management of journey monitoring devices and driver image recording systems, and other relevant legal regulations.
Additionally, under Clause 3, Article 5, traffic police may also monitor vehicles through data obtained from vehicle weight monitoring systems.
Traffic police units assigned to patrol specific routes or areas are responsible for collaborating to receive data from vehicle weight monitoring systems installed along these routes or areas, in accordance with the Law on Road Traffic Safety and related legislation. This data will be used to monitor, detect, and address violations of road safety laws, vehicle weight limits, and other legal violations.
The introduction of Circular 73/2024 marks a significant step forward in modernizing Vietnam’s road traffic enforcement. By integrating data from journey monitoring systems, driver image devices, and vehicle weight control systems, the traffic police aim to:
