
On April 1, the Government issued detailed guidance to remove legal and procedural obstacles for projects and land plots subject to inspection conclusions, audits, or court rulings in Ho Chi Minh City, Da Nang, and Khanh Hoa province.
In Da Nang, the validity period of land use rights stated on previously issued land use certificates (LURCs) will be adjusted to 50 years if violations regarding usage duration are identified.
Within 20 days of the decree’s effective date (April 1), the Da Nang Department of Natural Resources and Environment must publish a list of LURCs requiring term reassessment. The Land Registration Office will then have five days to update cadastral and land database records.
Land users or property owners will be notified in writing of the land use term adjustments. During the reissuance or amendment process, applicants will not be required to pay fees or service charges.
In Ho Chi Minh City, for Project No. 39–39B Ben Van Don (District 4), the decree specifies that after investors are permitted to continue using the land under Article 6 of Resolution No. 170, the issuance of land use right certificates to the investor or transferee shall follow Decree No. 101/2024/ND-CP.
However, if a legally effective court judgment contains provisions on land handling that differ from Article 6 of Resolution No. 170/2024/QH15, then the binding court decision will prevail.
In Khanh Hoa province, the decree outlines the procedures for reviewing land conditions, determining land prices, and calculating land use and rental fees for 11 specific projects governed by Article 5 of Resolution No. 170.
For each project, the Department of Natural Resources and Environment will take the lead in coordinating the review of approved land-use or urban planning (general or zoning plans), determine whether there are encroachments on defense or security land, and assess the investor’s project execution capability.
The department will consolidate assessments and inputs from relevant agencies, then submit a report to the Khanh Hoa Provincial People’s Committee. The Committee will evaluate whether each project is eligible to continue using the land. If a project is deemed ineligible, land will be reclaimed following the same legal process applied in land law violation cases.
Additionally, the Government decree provides detailed guidance on land valuation methodologies for 16 projects in Da Nang and outlines procedures for land price determination and land use fee collection for a project in Ho Chi Minh City.
